Right of access of the data subject

  1. The data subject has the right to obtain from the data controller confirmation as to whether or not personal data concerning him or her are being processed and, where that is the case, the right of access to the personal data and to the following information:
    • the purposes of the processing,
    • the relevant categories of personal data,
    • the recipients or categories of recipients to whom the personal data have been or are to be disclosed, in particular recipients in third countries or international organisations,
    • if possible, the period for which the personal data will be stored or, where this is not possible, the criteria determining that period,
    • the existence of the right to submit a request to the data controller for rectification or erasure of personal data or restriction of the processing of personal data concerning the data subject or the right to object to such processing,
    • the right to submit a complaint to a supervisory authority,
    • any available information regarding the origin of the personal data, when the personal data are not collected from the data subject, 
    • the existence of automated decision-making, including profiling, as provided for in Article 22 (1) and (4) of the GDPR and, at least in such cases, meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the data subject.
  2. When personal data are transferred to a third country or to an international organisation, the data subject has the right to be informed of the appropriate safeguards in accordance with Article 46 concerning the transfer.
  3. The data controller shall provide a copy of the personal data being processed. For additional copies that may be requested by the data subject, the controller may charge a reasonable fee for administrative costs. If the data subject submits the request by electronic means and unless the data subject requests otherwise, the information shall be provided in a commonly used electronic format.
  4. The right to obtain a copy referred to in paragraph 3 shall not adversely affect the rights and freedoms of others.

Right to rectification
The data subject has the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject has the right to have incomplete personal data completed, including by means of a supplementary statement.

Right to erasure

  1. The data subject has the right to obtain from the controller the erasure of personal data concerning him or her without undue delay, and the controller shall be obliged to erase personal data without undue delay, if there is one of the following reasons :
    • the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed,
    • the data subject withdraws the consent on which the processing is based
    • the data subject objects to the processing and there are no compelling and legitimate reasons for the processing
    • the personal data was processed unlawfully,
    • the personal data must be erased in order to comply with a legal obligation under Union or Member State law to which the controller is subject,
    • the personal data have been collected in connection with the provision of information society services referred to in Article 8(1) of the GDPR.

The right of data erasure does not apply to the extent that processing is necessary:

  1. for the exercise of the right to freedom of expression and the right to information,
  2. for compliance with a legal obligation requiring processing under Union law or the law of a Member State to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority assigned to the controller,
  3. for reasons of public interest in the field of public health in accordance with Article 9, par. 2, (h) and (i), as well as Article 9, par. 3 of the GDPR,
  4. for archiving purposes in the public interest, for scientific or historical research purposes or for statistical purposes.
  5. for the establishment, exercise or support of legal claims.

Right to restriction of processing

  1. The data subject shall have the right to obtain from the controller restriction of processing where one of the following applies:
    • the accuracy of the personal data is contested by the data subject, for a period of time enabling the controller to verify the accuracy of the personal data,
    • the processing is unlawful and the data subject opposes the erasure of the personal data and requests, instead, the restriction of their use,
    • the controller no longer needs the personal data for the purposes of the processing, but the data subject requires them for the establishment, exercise or defence of legal claims,
    • the data subject objects to the processing pursuant to Article 21, par. 1 of the GDPR, pending verification of whether the legitimate grounds of the controller override those of the data subject.

Right to data portability

  1. The data subject has the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format, and has the right to transmit those data to another controller without objection from the controller to whom the personal data were provided, when:
    • the processing is based on consent pursuant to Article 6, par. 1 (a) or Article 9 par. 2 (a) or on a contract pursuant to Article 6 par. 1 (b) of the GDPR and
    • the processing is carried out by automated means.

Right to object

  1. The data subject has the right to object, at any time and for reasons relating to his or her particular situation, to the processing of personal data concerning him or her by automated means.
  2. If personal data are processed for direct marketing purposes, the data subject has the right to object at any time to processing of personal data concerning him or her for such marketing, including profiling, if it is related to such direct marketing.
  3. When data subjects object to processing for direct marketing purposes, the personal data shall no longer be processed for these purposes.

How long do we retain Personal Data?
